Due to recent events regarding the DEA sounding the alarm on synthetic enhanced 7-OH products, there has been a lot of confusion over legality. We've created this map to help breakdown state by state kratom legality including: where Kratom Consumer Protection Acts (KCPA) have been passed, kratom is legal, kratom is legal but may have local bans or where it is outright banned.

The Kratom Consumer Protection Act (KCPA)

Kratom is currently legal in most states in the US, and consumers in these states can thank sponsors, leaders, grass roots advocacy groups supporting the Kratom Consumer Protection Acts for helping to keep it that way.

The KCPAs are written to address the concerns of legislators, kratom users, and suppliers. It seeks to regulate kratom, ensuring only well tested and natural kratom products reach consumers. The act strikes a balance between providing access to kratom’s potential benefits and mitigating risks. There has been discussion recently as of mid-2025 for a federal KCPA to be introduced soon.

Federal Legality

Your freedom to purchase kratom powder online or get any kratom product has been fought for and will continue to be fought for. Over the years, multiple attempts have been made to limit access to kratom or ban it, even in states where a form of the KCPA has been passed and kratom is legally protected. Ban bills or legislation is constantly changing and we at Royal Kratom are constantly monitoring these bills to help you stay up to date. 

In 2016, the Drug Enforcement Administration (DEA) heavily wrestled with kratom’s legality. 

  • The FDA has previously issued warnings about kratom due to misinformation and the risks of synthetic products.
  • The DEA aimed to classify kratom's main alkaloids, mitragynine and 7-hydroxymitragynine, as Schedule I controlled substances; however, the DEA temporarily withdrew its intent due to strong public backlash and testimonies about the plant's benefits. 

Enacting the KCPA at the federal level would go a long way in making sure that legal kratom is available in the US, and protecting the consumer’s right to make their own decisions regarding its use.

State Legality

Each state exercises its autonomy from the federal government in setting regulations and laws regarding substances, leading to a patchwork of legal statuses for kratom across the nation. This variation makes it imperative for users and vendors to be well-acquainted with regional and local laws to determine where kratom is legal.

Bans and Partial Bans

A glance at the kratom legality map will show you if your state has a ban, but whole-state bans are only part of the story.

States that have adopted the Kratom Consumer Protection Act are generally safe, but in California and other states highlighted in yellow, some cities and counties have implemented local bans.With this in mind it is essential to get the latest information that applies to your state, county, city, or township by looking at your local resources or contacting us

State Bans

Kratom can get you in serious trouble in the following six states where kratom is currently banned.

  • Alabama
  • Arkansas
  • Indiana
  • Vermont
  • Rhode Island
  • Wisconsin

Some states, as the kratom legality map indicates, have partial bans.

Local or County Bans

Kratom is legal in the following US states with some exceptions. 

  • California – Kratom is banned in San Diego, Oceanside, and recently in Newport Beach
  • Florida – Florida does not ban kratom except for Sarasota County
  • Illinois – Kratom is illegal in Alton, Edwardsville, Glen Carbon, and Jerseyville, and was recently banned in Orland Park.
  • Mississippi – Kratom is illegal in several cities and counties and recently is subject of a 25% excise tax. 
  • New Hampshire – Kratom is legal everywhere but in the city of Franklin.
